Terms of Service

These are the terms for using HomeGen. By using the HomeGen iOS app or any related service, you agree to these terms.

TL;DR

• HomeGen is a tool that turns your walkthrough video into a listing reel.
• You own everything you put into HomeGen (your videos, your voice, your listings) and everything that comes out (the finished reels).
• We charge a monthly subscription. Cancel anytime via Settings.
• Don't use HomeGen for anything illegal or for property you don't have the right to market.
• We provide HomeGen "as-is." Things break sometimes. Our liability is capped at what you've paid us.

1. The service

HomeGen takes a phone-shot walkthrough video plus listing details and produces a finished listing reel using AI: script writing, voice generation (your cloned voice or a library voice), scene editing, branding overlays, and music.

We may change what HomeGen does over time. We'll tell you about material changes in advance.

2. Who can use it

You need to be:

• 18 or older.
• A licensed real-estate professional, OR producing video for property you have written authorization to market.
• Able to enter into a binding contract under U.S. law.

If you're using HomeGen on behalf of an organization, you confirm you have authority to bind that organization.

3. Your account

• You sign in with your Apple ID via Sign in with Apple.
• You're responsible for keeping your Apple ID secure. We rely on Apple's authentication.
• One account per real human. Don't share accounts or resell HomeGen access.

4. What you can put into HomeGen

You can upload:

• Walkthrough videos of properties you have the right to market.
• A voice recording of yourself for voice cloning.
• Listing details (address, price, features) that are accurate and lawful.
• Your headshot, brokerage logo, and other brand assets you own or have a license to use.

You may not upload:

• Footage of properties you don't represent.
• Voice recordings of anyone other than yourself.
• Listing details you know to be false (mis-priced, mis-stated square footage, false MLS claims, etc.).
• Content that's illegal, hateful, harassing, or violates someone else's IP.
• Anything that depicts minors in a way that could be exploitative.

We may remove content that violates these rules. Repeat violations end your account.

5. Who owns what

• You own your source videos, voice samples, listing data, brand assets, and the finished renders HomeGen produces from them.
• HomeGen owns the app itself, the rendering pipeline, the model prompts, the visual templates, and any improvements to the product.
• You grant us a license to process your content solely to provide the service (run renders, store data, deliver outputs). We don't use your content to train AI models or sell to third parties — see the Privacy Policy.
• This license ends when you delete your account, except for finished renders you've explicitly chosen to keep on our servers.

6. Subscription, billing, refunds

• HomeGen is a paid subscription. You pick a plan in the app.
• Plans renew automatically every month until you cancel.
• We bill through Stripe. You can manage payment, switch plans, or cancel anytime via Settings → Manage Subscription in the app.
• Cancel = no future charges. Your subscription stays active through the end of the period you've already paid for.
• We don't generally offer pro-rated refunds for partial months. If something on our end clearly broke and you've been billed for unusable service, email us at ethan@homegen.app and we'll make it right case-by-case.
• Render limits per plan are reset at each billing renewal. Unused renders don't roll over.
• Prices may change. We'll give you 30 days notice before any price increase takes effect on your account.

7. Acceptable use

Don't:

• Scrape, reverse-engineer, or attempt to copy HomeGen's pipeline.
• Use HomeGen to generate content you're not legally authorized to produce.
• Try to abuse the render quota (multiple accounts, bots, etc.).
• Interfere with the service for other users.

If you're not sure whether something's OK, ask first.

8. Service availability

HomeGen runs on third-party infrastructure (Modal, Cloudflare, Stripe, ElevenLabs, Anthropic). When those services go down, HomeGen goes down. We aim for high availability but don't promise uptime.

Maintenance and updates may temporarily interrupt renders.

9. AI-generated content disclaimer

HomeGen uses AI to write scripts, pick shots, and generate voiceover. The output may:

• Misstate facts about your listing.
• Sound unnatural or off-brand in places.
• Pick shots that don't represent your property well.

You are responsible for reviewing every render before publishing it. The review screen in the app lets you edit the script and remove shots before final output. Use it.

10. Disclaimer of warranties

HomeGen is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that:

• HomeGen will be uninterrupted or error-free.
• AI-generated output will be accurate or suitable for any specific listing.
• Defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law:

• Our total liability to you for any claim arising out of HomeGen, in any 12-month period, is capped at the amount you actually paid us in that 12-month period (or $50, whichever is greater).
• We are not liable for indirect, incidental, consequential, or punitive damages — lost sales, lost listings, reputational damage, etc.
• This limitation applies regardless of the legal theory (contract, tort, statute).

Some jurisdictions don't allow limitations of liability. If you're in one, the limitations above apply to the maximum extent permitted in your jurisdiction.

12. Indemnity

You agree to indemnify and hold HomeGen harmless from claims, damages, and expenses arising from:

• Your use of HomeGen.
• Content you upload that you didn't have the right to upload.
• Your violation of these Terms.

13. Termination

• You can terminate anytime by canceling your subscription and deleting your account.
• We can terminate your account if you violate these Terms (we'll give notice unless the violation is severe — illegal content, fraud, abuse).
• On termination, your account data is deleted per the schedule in the Privacy Policy.

14. Governing law + disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes go to state or federal courts in Monterey County, California, and you consent to that jurisdiction.

15. Changes to these terms

We may update these Terms over time. Material changes will be notified by email + in-app banner at least 14 days before they take effect. Continued use after the effective date = acceptance.
